By an order dated September 8, 2026 (Case No. 201/13665/26), the investigating judge of the Sobornyi District Court of Dnipro denied the SBU's motion to suspend Kusheleva from her position!

The prosecution's failure was not driven by insufficient evidence of wrongdoing, but by sheer bureaucratic negligence: SBU investigators and supervising prosecutors compiling filings under Article 155 of the Criminal Procedure Code failed to attach an official copy of the executive decree appointing Kusheleva as Department Director! The judge returned the motion, ruling that absent the appointment order, the court could not formally establish that the suspect held the office from which she was to be barred.

As a result, Albina Kusheleva remains in a strategically advantageous position: released on bail and completely unsuspended, she legally retains her directorship, signature authority, physical office, internal server access, and institutional control over departmental subordinates acting as prosecution witnesses.

The defense’s effort to construct a public narrative of victimization through friendly local outlets and emotional online statements collapses when confronted with the legal record.
